The Dike Ada family of Umuchi Mgbidi, Oru West Local Government of Imo State on Friday accused Maranatha University Mgbidi of using all fraudulent tactics to forcefully take over their land.
Barr Oguaju Dike, the Attorney to the royal family stated this while fielding question from our correspond in Owerri shortly after the land matter between the family and Maranatha University .
The National Universities Commission (NUC), the Attorney General of the Federation, Federal Ministry of Education and 4 others defendants and respondents were all joined in the matter by the royal family .
According to the family lawyer ," on the 25th of November, 2021 , the Federal High court 1 Owerri presided over by Justice M.A Onyyetenu for motion to commit the Maranatha university and its proprietors to prison for disobeying the order of court made on 23rd of july, 2021 to maintain status quo but because they defendants don't want to go to jail they rushed to Appeal Court ."
He said," the motion filed in the court of appeal owerri by Maranatha university for stay of execution of the order made by Federal High Court Owerri on 23rd July 2021 to maintain status quo as at that date against which Maranatha university appealed to the court of appeal "
He said," rushing to the Court of Appeal doesn't change anything because the order to maintain status quo has not been discharged."
The senior lawyer said,"till today the proprietors of MARANATHA UNIVERSITY are still advertising for admission even defrauding unsuspected Nigeria students seeking admission."
Reacting further on the court proceeding , Barr Dike said," the court today asked all parties to wait and adjoined the matter till 5th April, 2022 because the defendants have filled an appeal against the High Court Owerri status quo order stopping Maranatha University Mgbidi from the planned take off."
The family Attorney said," We are going to the court of appeal now. The court says let the Appeal Court say something before it would continue on the 5th of April , 2022."
Maranatha University is not valid to be a private University because it didn't fulfil the needed requirements. The law on establishment of private University says a private school must have a land and site plan but this one doesn't have, he said.
"They broke into our family land and we sued them.They are using all fraudulent tactics but the issue is that the people that owned the land are not happy.
On the 18th of August the DSS invited all parties involved to sign an undertaking that they will maintain peace and maintain status co and we all did."
All efforts to reach the institution for reaction proved abortive .
