Imo Assembly considers bill to amend ACJ law

A bill to amend the Imo State Administration of Criminal Justice Law No. 2 of 2020 has been passed into law by the state House of Assembly led by Rt. Hon. Paul Emeziem.

The bill before its passage, sought to amend sections of the law which according to the sponsor, Emeka Nduka, member representing Ehime Mbano, seems ambiguous and viewed by some people as obnoxious and unconstitutional.

The sponsor contended that, even though no section of the law empowered the governor of the state to arrest and detain any person at his pleasure, there was need for the amendment for clarity purposes. 

He posited that a person to be so detained must either be a person of unsound mind or minor and the arrest and detention of such a person must be on the order of a competent court.

Nduka said, "any person in this section, shall include only a person of unsound mind; or a minor."

He therefore prayed the House to accelerate the passage of the 'Executive' bill to erase misconception of some sections of the law and for effective and speedy dispensation of justice in the state.

Meanwhile, some lawmakers including the Minority Leaders, Anyadike Nwosu (Ezinihitte Mbaise), Arthur Egwim (Ideato North) and Dominic Ezerioha (Oru West), who spoke on the bill at the plenary applauded the governor, Sen. Hope Uzodinma for seeing the need to give clear interpretation to the law through the bill.
